Article 1  In order to enhance arts and cultural activities toward diversified development in Nantou County (hereinafter referred to as this “County”), fostering the public participation in arts and cultural activities, to promote artistic culture integrated into the people life, rich the public spaces of this County for human landscape and spiritual life, permit buskers engaged in arts and cultural activities, the Nantou County Government (hereinafter referred to as this “Government”) hereby does specify this approach.
Regarding to the buskers engaged in artistic and cultural activities permit matters in this County, except where otherwise prescribed by the Central Ordinance, pursuant to this Approach.
Article 2  The Competent Authority of this Approach is this Government, the Executive Authority is the Culture Bureau of this Government.
Article 3  The terms of this Approach are defined as follows:
        一I、Public space: refers to announcement by the competent authority the place is opening at free of charge provided for buskers engaged in arts and cultural activities.
        二II、Public space administrator: refers to a specific public space in accordance with the decree or the contract who has the right to manage.
        三III、Arts activities: refers to the performing arts, visual arts, crafts and other arts related to the scene creation activities.
        四IV、Buskers: refers to the public space who engaged in arts activities of individuals or a group of ten (10) members or less.
Article 4  Buskers in public space of this County are engaged in artistic and cultural activities, who shall apply to the competent authority for verification of this County street performer certificate (hereinafter referred to as “Busker Permit” license”), and pay the examination fee, one individual pays NT $500, one group pays NT $1000.
In order to handle the application of Busker Permit, the Competent Authority shall invite scholars and experts to set up the Review Committee for proceeding, if necessary, shall notify the applicant in the designated Venues for explaining, acting, demonstrating or performing play, after audited and approved by the Review Committee, will issue to give the Busker Permit.
The busker permit issued by the competent authority, shall be effective for three years, the expiration expires automatically lapse. But the busker shall be within two (2) months prior to permit license expiry, submitting application, old permit license and perform play outcome data, to apply to the competent authority for permit renewal and pay the renewal fee of NT $200. Once the busker permit got lost or destroyed, may apply for a replacement, application process and fee are same as the permit renewal done.
Once the busker hold the busker permit issued by outside other county (city) authorization within the effective period, shall submit the application forms, the busker permit copy and the perform play outcome data issued by outside other county (city) authorization, apply to local competent authority for a busker permit, required fee is same as the permit renewal done.
Article 5 The street performer who achieved busker permit engaged in artistic and cultural activities, shall comply with the management specification of public space, may not affect the other activities permitted by the public space administrator.
          The buskers engaged in artistic and cultural activities effected to others for fair use, the executive authority or public space administrator shall be depending on the factors such as activity patterns and audience reactions, flexible to adjust the area in which they engaged in artistic activities.
          The public space administrator shall provide the necessary assistance to the first article mentioned that the buskers engaged in the arts and cultural activities.
Article 6 Buskers engage in artistic and cultural activities in the public space of this County, who shall toward the public space administrator proceed the registration for their filing in seven (7) days prior to activities opening, enabling time from nine (9) o'clock in the morning to nine (9) o'clock in the afternoon. However, the public space Administrator if otherwise stipulates, please follow from its provisions.
Article 7 Buskers engaged in artistic and cultural activities contents, may not obstruct public order or good customs.
Article 8 Charges from Buskers engaged in artistic and cultural activities was defined by its own. It shall be clearly marked on site.
Article 9 Buskers engaged in artistic and cultural activities shall prominently reveal the busker permit on the site, and also shall accept the inspection of the executive authority, police officers and public space administrator. Buskers may not arbitrarily transfer the busker permit for use by others, if go for others to use, the competent authority may revoke the original busker permit, and may not again apply for issuance within one year since the date of the exemption.
Article 10 Buskers in public spaces may not engage or sell, the artistic and cultural activities, goods or services that do not conform to the approved projects from the busker permit.
Article 11 Buskers engaging in art activities may not cause pedestrian or vehicular traffic difficulties, impede the barrier-free facilities, hinder traffic or public safety behaviors on the building exits or fire safety, equipment.
Article 12  Buskers engaging in artistic and cultural activities may not affect the environment, peace, and shall pay attention to maintaining public spaces clean, after the event shall be responsible for reinstatement.
Article 13  Buskers engaging in artistic and cultural activities in public space besides accept the permit checks stipulated in article nine (9), but also shall be aligned with executive authority, police officers or public space administrator for inspection. Any busker who violates this approach or the relevant specifications, the executive authority or public space administrator shall be depending on the circumstances for the following disposal:
          一I、Written admonition.
          二II、Order it to stop the activities immediately.
          三III、Prohibit buskers apply for the previous public spaces ever with illegal they made to engage in artistic and cultural activities within a certain period of time.
According to the notifications which are examined to violate this approach or relevant specifications more than three times, or the violation serious events which are identified by the executive authority, the competent authority may revoke the original busker permit, also may not apply for the busker permit issuance within one year since the date of the exemption.
Article 14 When buskers in public space of this County engage in artistic and cultural activities, they shall be focus on the activities contents, personally set up safety maintenance facilities, or insure public accident liability insurance.
Article 15 The public space in which Buskers perform in this County, shall be the notice announced by the competent authority.
Article 16 The required forms referred to this approach are defined by the Competent Authority under separate notice.
Article 17 This approach shall be enforced as of the promulgation date.
